Religious Nonprofits Won't Pay For Birth Control Under Proposal

After a year of lawsuits and public outcry,?the?Obama administration proposed?Friday?a way for women who work at nonprofit religious institutions to get free birth control without requiring their employers to pay for it.

Instead, institutions that insure themselves, such as hospitals and universities,?could use a third party to find a separate health policy that would pay for and provide the coverage. The costs would be?offset by the fees insurers pay to participate in the new online health marketplaces set to open in October under the health law.

?Today, the administration is taking the next step in providing women across the nation with coverage of recommended preventive care at no cost, while respecting religious concerns,? Health and Human Services Secretary Kathleen Sebelius said in a press release. ?We will continue to work with faith-based organizations, women?s organizations, insurers and others to achieve these goals.?

The proposed rule is aimed?mainly at groups affiliated with churches, such as hospitals and educational institutions. It?is unlikely to satisfy the concerns of private businesses, however, which?have brought?several dozen lawsuits?against the health law?s contraceptive mandate saying it violates their religious beliefs.??The rights of family businesses like Hobby Lobby are still being violated,? said Kyle Duncan, general counsel of The Becket Fund for Religious Liberty, which represents several groups that have filed suit. Some of those?lawsuits are expected to make their way to the U.S. Supreme Court.

Cardinal Timothy Dolan of New York, president of the U.S. Conference of Catholic Bishops,?said in a statement that the organization welcomes ?the opportunity to study the proposed regulations closely. We look forward to issuing a more detailed statement later.?? A similar statement was issued by the Catholic Health Association, which includes scores of hospitals and health groups affiliated with the Roman Catholic Church.

Here?s the way?the proposed rule would work:

It clarifies the definition of ?religious employers? to follow that of Internal Revenue Service code, and to include all houses of worship and their affiliated organizations.

Religious organizations that self-insure, as well as student health plans, would let their third party administrator know that they object to?providing contraceptive coverage on moral grounds. The administrator would then work with a health insurer to provide separate individual contraceptive coverage at no cost to the enrollees.? The cost would be ?offset by adjustments in federally-facilitated exchange user fees that insurers pay,? according to the administration.

Nothing would change for a religious organization that offers a group plan: Under the compromise offered by the administration last February, the insurer would provide separate contraception coverage at no cost to participants. The administration argues that such services would be cost-neutral to insurers because they would result in fewer births.

Under the health law, employers who insure their workers are required to cover government-recommended preventive services without co-payments. In August 2011, the Obama administration said those would include contraceptive services, such as birth control pills, implants and sterilization procedures.

Religious organizations opposed to birth control sought to be exempt. The Obama administration initially gave them a one-year delay, until August of this year, to comply, while promising further compromise.

Ilyse Hogue, president of NARAL Pro-Choice America, praised the proposal, saying it?would ensure that ?most American women will get birth-control coverage without extra expense.?

But others skewered it.

?The contraception compromise is a compromise only from the perspective of the Obama administration,? said Benjamin Domenech, a research fellow at The Heartland Institute, a libertarian think tank in Chicago. ?Nothing significant has changed. Religious employers will still be required by law to pay an insurance company that will provide sterilization, contraceptive, and abortion inducing drugs. That was true before this announcement, and it is still true today.?

Insurance consultant Robert Laszewski of Health Policy and Strategy Associates?said the administration ?way underestimated? the strong feelings about contraceptive services among?some religious Americans. To fulfill its promise of no-cost contraceptive services, he said, the latest compromise transfers the costs of covering a relatively small number of women to the new health insurance marketplaces.

While that cost will eventually be passed onto consumers, he said, ?we?re talking nickels and dimes here.?The Obama administration is correctly assuming that the cost is going to be a rounding error.?

Nonetheless,?that?s unlikely to satisfy religious employers for whom the issue?was never about cost, but about religious principles, Laszewski said.

Ousted 'Loser' and husband drop 150 pounds

When mother of four Lisa Rambo arrived on "The Biggest Loser" ranch, she weighed in at 246 pounds. She left the ranch 37 pounds lighter, but her journey didn't end there. Despite being voted out of the competition in week five, she went on to prove she's a "Loser" winner all the same.

"I've lost over 80 pounds so far -- six weeks left to go," Lisa revealed during a Monday morning visit to TODAY.

And her accomplishment goes beyond her own results on the scale. She inspired husband Tony to drop 70 pounds too.

"Between the two of us, we've lost a healthy adult," she boasted of their combined 150-plus-pound loss.

As for the secret to her ongoing success, Lisa credits "Loser" trainer Dolvett Quince with lighting "a fire in (her)," but ultimately chalks it all up to a simple routine.

"Who knew diet and exercise actually works?!" she said with a laugh.

Refinance or pay down a mortgage - Zillow Mortgage Advice

January 31, 2013 at 7:39 pm My original mortgage is 30 yr fixed at 5.5% the remaining balance is 122,000 w 19 years remaining. I???m trying to refinance for 3.37% on a 15 year. Current payment is $864 a mo not including escrow. With all the closing costs rolled in the mo payment will be $915 a month and the new balance will be 129,000. Because I need an extension they added another $2000 to the closing costs. My goal was to save money long term and shorten the length of the loan. But with closing costs almost reaching $9,000 I???m beginning to wonder if it would be better to just add an extra payment a year. Does this refinance seem worth it? How much money am I saving with the refinance as opposed to keeping original loan and adding an extra payment a year or more?

Rutgers to name anti-bullying center after Clementi

On Monday, Rutgers University and the family of Tyler Clementi -- the freshman who committed suicide after his roommate used a webcam to film him in a romantic encounter with another man -- will announce the newly created Tyler Clementi Center at the New Jersey college, dedicated to helping students transition from home to university life.?

The ceremony at the campus will include members of Clementi's family, who started a foundation after his death focused on bullying, youth suicide and other issues related to gay students, the Star-Ledger reported.

"The Tyler Clementi Center is a collaborative effort between Rutgers University and the Tyler Clementi Foundation," Rutgers officials said in an announcement.

"The center will draw from academic disciplines across the university and throughout the nation to create new programs and approaches to address issues that confront young people ? specifically youth making the transition from home to college."


Although Joseph and Jane Clementi, Tyler's parents, filed court papers shortly after their son's death in 2010 preserving their right to sue Rutgers for damages, the family chose not to file suit anyone associated with the webcam spying or the suicide, the family's attorney Paul Mainardi said in October.?

"The Clementi family made a considered decision to not pursue civil suits," Mainardi told the Star-Ledger. "They are devoting their energies to the positive work of the Tyler Clementi Foundation."

Last year, the university and the Clementis? newly formed foundation co-sponsored a symposium on bullying and social media on the Piscataway campus. Nearly 200 academics and school officials attended, the Star-Ledger reported.

The new Tyler Clementi Center will offer lectures, symposia and training on the misuse of social media and youth suicide, Rutgers officials said. The center will also focus on cyber bullying and the adjustment to adulthood and college life.

"The goal of the center is to provide scholarly support for the work of policymakers, social activists, community leaders and other advocates for vulnerable youth," Rutgers officials said.

Two of the university's professors will serve as directors of the center.?

Clementi, 18, jumped off the George Washington Bridge in 2010, a few weeks after he started his freshman year.

His roommate used a webcam to watch the freshman in a romantic encounter with another man in their dorm room, then boasted about what he had seen on Twitter. Clementi, who had told his parents he was gay weeks before leaving for college, filed a complaint about the spying with university officials hours before his suicide.

Clementi's roommate, Dharun Ravi, was found guilty of invasion of privacy, bias intimidation and other charges in a nationally televised trial last year. He served less than a month in county jail.?

Ravi is currently appealing his sentence.?

Economic jitters compete with Obama agenda

(AP) ? Just as President Barack Obama is pushing new initiatives on gun control and immigration, the gloomy old problem of a sluggish economy is elbowing its way back into prominence. Consumer confidence is falling, the economy is contracting and large automatic spending cuts are threatening to hit the Pentagon and other programs, with uncertain consequences.

These troubles arise as Obama's public approval is improving and as he begins to use his sway to promote the key features of his second-term agenda. The White House, the Federal Reserve and independent economists attributed the shrinkage in gross domestic product and the drop in consumer confidence to one-time events and said underlying economic factors were still showing encouraging signs.

But in politics, power resides in the moment. Any immediate economic setback ? or the perception of one ? could weaken Obama's clout or at least distract him as he carefully tries to put his imprint on initiatives dealing with immigration and gun violence.

At the White House, there was no evidence of a course alteration. And White House officials expressed confidence in consumption and investment trends that showed evidence of strength.

But the Commerce Department announcement Wednesday that the economy shrank at an annual rate of 0.1 percent came a day after the Conference Board reported a sharp decline in consumer confidence in January. That drop, together with one in December, erased consumer confidence that had built up in 2012.

What's more, the new data comes just two days before the government releases the January unemployment report, which economists believe will stay at the still-high rate of 7.8 percent, where it has held for two months.

"What's most critical to consumer confidence is employment," said Lynn Franco, director of economic indicators at the Conference Board. "We've had spurts where we've had strong job growth and we've seen a rebound in confidence, and then suddenly you have a pullback in employment and you get a pullback in confidence. So we need a convincing story, and that's going to take several months of jobs growth."

Analysts said the economy is still on track to grow steadily if modestly at a roughly 2 percent pace, as long as the housing and auto industries continue to recover.

The Commerce Department attributed the economic contraction mainly to companies restocking at a slower rate and to reductions in government spending on defense. While companies will ultimately have to rebuild their inventories, the cuts in defense spending could offer a hint of things to come.

The administration argued that the 22 percent reduction in defense spending was partly in anticipation of automatic spending cuts that were going to take effect at the beginning of the year. Obama and congressional Republicans averted that so-called fiscal cliff by extending Bush-era tax rates to all but the wealthiest Americans.

But the deal simply delayed the automatic cuts until March 1. At that point, the Pentagon faces across-the-board cuts of 7 percent, while domestic programs will have to shrink by 5 percent. Some analysts believe that if those cuts are allowed to occur, as some Republicans are now suggesting, the economy could lose a half a percentage point of growth.

"If the economy would continue to slow down, the interesting question is how does that affect negotiations in and around sequester, government spending, tax reform, the debt ceiling," said John Sides, a political scientist at George Washington University who studies the impact of economic data on politics. "To me it's not so much that an economic slowdown is going to hurt the president's ability to get things done, it's how it's going to affect the negotiations that we already know are going to happen."

Some in the business community hope the experience in the last quarter will alert lawmakers to the potential economic damage the automatic cuts could create.

"I don't think any time you see a reduction in economic growth that it's good news," White House press secretary Jay Carney conceded Wednesday.

But he cautioned, "We need to make sure that in Washington we are not taking actions that undercut that progress that we have been making and can continue to make and will continue to make."

Carney said letting the automatic cuts take effect is a "sort of political brinksmanship of the kind that results in one primary victim, and that's American taxpayers, the American middle class."

Still, the White House insists the only alternative to those cuts is a mix of savings and new tax revenue. Republicans say the $600 billion in revenue they already gave Obama as part of the New Year's fiscal cliff deal is enough. They insist that if he wants different spending cuts than those due to start on March 1, he should submit a new plan.

But the White House has been eager to move away from fiscal and budget fights, ready to use the president's re-election and the uptick in his popularity to push his noneconomic agenda.

On Tuesday, he traveled to Las Vegas to push for an overhaul in immigration. On Monday, he is traveling to Minneapolis to promote his proposals to reduce gun violence.

The issues are not simple ones for Obama. The economy and the nation's debt still rank higher than immigration and guns as issues in the mind of the public. Moreover, Obama has to navigate gingerly with Congress on immigration, where a fragile coalition of Democrats and Republicans is assembling legislation that, among other things, could provide a path to citizenship for 11 million illegal immigrants in the U.S.

Obama has vowed to use his bully pulpit to build public support for his new agenda. Defending his economic stewardship was not supposed to be part of the playbook.

Mother of Taft Union shooting victim: 'I'll never take his voice for granted'

The mother of Taft Union High shooting victim Bowe Cleveland said he's steadily improved and has been transferred out of Kern Medical Center's intensive care unit with the hope that he'll be well enough to travel home in a week or so.

The 16-year-old faces a long road to recovery. His body is filled with shotgun pellets, and months of physical and psychological therapy are ahead.

But Leah Cleveland said a milestone was reached earlier this week when Bowe was able to speak to her for the first time since he was shot at school.

He told his mother he loved her.

"Oh my gosh, I'll never take his voice for granted," Cleveland said Wednesday. "When he first opened his eyes it was like giving birth again."

When he gathered more strength, Bowe told her he remembered everything that happened before the Jan. 10 shooting, including hearing what sounded like a gunshot, Cleveland said. Some students hit the floor, Bowe stood up, was shot and collapsed.

"He remembers after he was shot that every time he took a breath blood was squirting out of his lungs," Cleveland said.

He also remembers the extreme pain he was in, and the ambulance and helicopter rides that brought him to the hospital. The teen wondered if he was dreaming.

Cleveland spoke while seated next to attorney Daniel Rodriguez, who filed a claim against the Taft Union High School District on Wednesday alleging district officials knew, or reasonably should have known, that student Bryan Oliver was dangerous, threatening and likely to commit a violent act. The district failed to take adequate precautions in connection with the dangers Oliver presented, the claim says. Oliver has been criminally charged in the shooting.

Both Cleveland and Rodriguez declined to answer questions about Oliver. They were adamant, however, that Bowe is not a bully, as some have claimed.

Rodriguez said Bowe, in fact, has been the victim of bullying in the past and was beaten so badly in seventh grade that he suffered a concussion. At 6 feet 4 inches tall and about 300 pounds, Bowe is the kind of person who some people target for a fight to prove how tough they are, Rodriguez said.

The teen's size has brought him a lot of misery, but it's also partly responsible for his surviving the shooting. Rodriguez said doctors told the family that Bowe's youth and size enabled him to survive so much blood loss.

Rodriguez said the family has one response for people accusing Bowe of bullying: "We're going to pray for you, and let's hope you never, ever, have to walk in our shoes."

Cleveland said Bowe doesn't judge anyone, and makes a point of not even playing rough with friends because of his size. He's outgoing and has no problem dancing or talking in front of a crowd.

He doesn't care about being cool, Cleveland said.

"He's large, but he's larger than life in personality," she said.

Cleveland was putting her contact lenses in and preparing to go to the gym when she received a call from a school official saying her son was injured and she needed to get there immediately. She didn't know what had happened, and figured Bowe had fallen or accidentally cut himself.

She drove to the school and saw a line of ambulances and police cruisers and realized something serious had happened. She frantically ran from her car -- with the keys still in the ignition -- to the front of the school.

"At that point I lost my mind," Cleveland said.

An officer grabbed her and told her that Bowe was "gone." She thought by gone he meant dead, not that he'd been taken away by ambulance.

She eventually came to understand that her son was still alive, and she was rushed to the hospital to join him. That first week she never ruled out the possibility that he might die.

Doctors told her that although Bowe couldn't respond, he could hear. So she allowed any student who wanted to see him to come in and talk to him.

Droves of students came to wish Bowe and the family well.

"The kids got me through," Cleveland said.

The claim

Rodriguez said he filed the claim to gain access to school records regarding a "hit list" that Oliver allegedly created targeting 30 students sometime before the Jan. 10 shooting. Rodriguez said he has repeatedly been told about the hit list, and that in the past Oliver threatened specific students, and told one he was going to kill and eat their pets.

"If you have a zero tolerance policy and a student is threatening violence, why didn't they kick him out?" Rodriguez said.

Interim Superintendent William McDermott has said laws protecting student privacy and the pending criminal case against Oliver prohibit him from discussing disciplinary action against individual students.

The claim, which is filed as a precursor to a lawsuit, names school officials including McDermott, Principal Marilyn Brown and Assistant Principal Rona Angelo as being negligent in their supervision of and failing to take adequate precautions against Oliver.

Authorities have said that Oliver entered a classroom and shot Cleveland and fired at but missed student Jacob Nichols in an incident that quickly made international news. Cleveland suffered injuries to his abdomen and chest.

Shotgun pellets grazed teacher Ryan Heber, who, along with campus supervisor Kim Fields, convinced Oliver to drop the gun, authorities said. Oliver has pleaded not guilty to two counts of attempted murder and three counts of assault with a gun on a person.

His next court date is Feb. 20.
